Depending upon random selection, some drivers may be tested more than once each year and some drivers may not be tested at all.
An Employer asks, "How can a company protect both itself and the employee?"
Having a drug policy in place will protect both the employer and the employee. Letting the employee know up front what is expected of him or her and what the repercussions will be if the employee tests positive for drugs is a good start.
Are there different rules and regulations for different types of companies?
Yes. A transportation company may have drivers who need to be DOT tested. Another company may have a drug policy in place because of insurance purposes or requirements of state law. While yet another company may have a policy because the owner feels the need to provide an alcohol-free and drug-free workplace.
Are drug tests confidential?
Yes, drug tests cannot be released to others without the written consent of the employee. There are exceptions, of course, such as arbitrative, litigative, or administrative proceedings arising from a positive drug test.

No! Employers need to make it clear, in their company drug and alcohol testing policy, that the employee can be random tested at any time on company time.
What happens if an employee has what is termed as a "shy bladder"?

This is where a drug policy can be of assistance. If the drug policy clearly spells out that when an employee cannot provide a specimen within the specified legal time the law spells out, which is 3 hours, then the employer can consider this a refusal by the employee to be tested.
Can someone fool a test?
Sure, anything is possible and many have tried to fool a drug test. However, if the test is a laboratory test, which includes a medical review officer, then it’s going to be very difficult.
Some employees are naive enough to believe that they can dilute the specimen with water, however, this is one of the first things that the lab searches for in testing. It is difficult to fool the lab.
This is actually the reason that there are procedures followed to prevent falsification of drug tests. For instance, when a person is being drug tested, he or she is not allowed to take a jacket or purse into the testing area. They are asked to remove items from their pockets. Faucets and toilet handles are taped off in the room where the testing is being done. Dye is put into the toilet water to deter anyone from adding water to their urine from the toilet.
